On the 19th April 2022, the Ministry of Justice announced that senior Court judgments and Tribunal decisions will be available in the National Archives. You can carry out a search here.
How helpful this will be for litigants will largely depend upon how good the search facility is. For example, it is possible to search by “specific keyword”. That might enable litigants to search for a particular topic or issue and come up with helpful case law.
Having had a quick look at the search facility, it does look user friendly. Our initial test searches carried out, did bring up entries very quickly indeed.
It might be worthwhile entering a search term relevant to your dispute in the search facility to see if anything helpful comes up. Please note however that these are more senior cases and it is unlikely that County Court decisions (small claims are almost always dealt in the County Courts) will be found.
